These General Terms of Use govern access to and use of this website (hereinafter, the "Website"), as well as the content, services and resources made available to users by JAC ON THE BEACH, S.L., under the trade name Go Bananas Tours.

Go Bananas Tours may modify the presentation, configuration, content and services of the Website at any time and without prior notice whenever it considers it appropriate.

Accessing and using the Website confers the status of User and implies full acceptance of these General Terms of Use. The User undertakes to use the Website lawfully, respecting current legislation, good faith, public order and the rights of third parties.

The User also guarantees that the data provided through the Website's forms is truthful and accurate, and undertakes to report any changes to it. Merely accessing the Website does not establish any commercial relationship between the User and Go Bananas Tours, unless a booking or purchase of one of the services offered is expressly formalised.

Go Bananas Tours makes every reasonable effort to ensure the Website works properly. However, it does not guarantee its permanent availability or the absence of technical errors.

The Website may contain links to third-party websites in order to provide additional information or certain services related to the activities offered. Go Bananas Tours works with a number of local tour operators, who are directly responsible for carrying out the activities booked. When an activity is provided by a partner operator, the customer will be informed of this during the booking process or in the booking confirmation.

Go Bananas Tours does not control the content of third-party websites and is not responsible for the information, policies, availability or services offered by those websites.

V. Intellectual and industrial property

All content on the Website, including but not limited to texts, photographs, videos, logos, trademarks, designs, icons, graphics, software and other elements, is the property of JAC ON THE BEACH, S.L. or of its respective owners, and is protected by Spanish, European and international intellectual and industrial property law.

The reproduction, distribution, transformation, public communication or any other form of exploitation of the Website's content is prohibited without the prior and express authorisation of JAC ON THE BEACH, S.L., except where legally permitted. The User may view, download and print the content for personal and private use only.

Use of images generated with artificial intelligence: in compliance with Regulation (EU) 2024/1689 on Artificial Intelligence, please note that some of the images published on this Website may have been generated or modified using artificial intelligence tools, solely for illustrative and promotional purposes for the services offered.

VI. Booking activities

Go Bananas Tours acts as an intermediary in the sale of tourist activities organised by duly authorised local operators. Booking an activity implies acceptance of each operator's specific conditions, including schedules, participation requirements, safety rules and cancellation policies.

Go Bananas Tours will manage bookings and payments in accordance with the conditions published on the Website, without prejudice to the liability of the operator responsible for actually providing the service.

VII. Legal action, applicable law and jurisdiction

Go Bananas Tours reserves the right to take whatever civil or criminal action it considers appropriate for misuse of the Website or its content, or for breach of these Terms. The relationship between Go Bananas Tours and the User is governed by Spanish law. In the event of a dispute, both parties submit to the courts with jurisdiction under current Spanish law, unless consumer protection legislation establishes another mandatory forum.
